These terms and conditions set out the basis on which you can use our website and place orders for items from picturethatgift.co.uk. By ordering goods from our website you are deemed to have understood and accepted these terms. If you continue to use our website this indicates your acceptance to these terms regardless of whether or not you choose to register with us or remain as a guest. You may only use this website (and the services provided through our website) if you agree to these terms.

Pricing

All prices on our site are set out in UK pounds sterling (£) and are inclusive of VAT and a economy delivery service. The delivery cost will increase according to the delivery method you choose during checkout. Any delivery times quoted are in working days this excludes handling time.

Registration

To register with www.picturethatgift.co.uk you must be eighteen or older and be the registered card owner when processing the order. We may suspend or cancel your registration immediately at our discretion if you breach any of your obligations under these terms and conditions.

You are responsible for keeping your password and user details confidential. We will not ask you for your password (except when you log in to the website).

Ordering

When placing an order with us online, We will send you an order acknowledgement by email, detailing the products you have ordered. Although we may have taken payment for your order, we may not actually accept the order. Its only once we review your order and check its okay that we will accept it. Please note that we reserve the right to cancel your order at any time and issue a full refund. However if this is the case we will contact you of the reason.

Payment

We accept most major Debit and Credit cards on our site. Your card details are transferred directly to our Payment Service Provider (www.paypal.com) for immediate authorisation and are never recorded or stored in our database. Once we have received authorisation from the Paypal we can process your your order. Paypal is one of the safest and known money handling sites in the world and you have the added security of making online payments. Please only order if you are the card owner.

Uploading

You must not misuse our Site or any part of the Service by introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.

In using the Photo Upload facility on the website, you agree not to upload any images that will cause offensive to anyone. It is your sole responsibility to make sure the image/photo or design does not infringe any copyright, database right or trade mark of any other person and we will not be responsible for any copyright infringement. We have the right to remove any material or posts a user makes on the Site.

Colour/Design

Whilst we try our very best to colour match every photo/design uploaded or designed on our website we cannot be held responsible for exact 100% colour match. However we aim to get a perfect match every time. Colours may appear differently on your computer/device screen than ours (due to contrast, hue settings on your monitor) and we will not accept returns for colour related issues. If exact colour matching is important then we suggest contacting us to discuss it.

Image/Photo Quality

All orders that are accepted are automatically sent to print, for this reason we are not able to replace/refund any order where a customer is not satisfied with the print quality of their image. The printer prints at high quality, but if given a low quality image the printer will detect and show this in the printout. If the photo is really poor or we cannot use the photo we may request an alternative. However the customer is fully responsible for the image supplied, we will assume that you own the copyright of this image and also are aware of its resolution. We will not accept returns on an image being of not high enough quality, its down to you to check this. If in doubt please contact us before ordering.

Delivery

Once your order is complete we will dispatch the goods to the address given at checkout. If any of the details you have given us is found incorrect, we are not liable for any items which have not been received.

Delivery will be made as soon as possible. Our working hours can vary depending on workload at the given time. We usually work Monday to Friday 9am – 6pm. We only process and dispatch orders during these times. All delivery and dispatch time scales quoted on the website do not include weekends or bank holidays.

Picture that Gift will endeavour to ensure that goods are delivered within the date stated in the selected delivery method at the time of purchase however we cannot be held responsible for delays caused via couriers and consequently are not obliged to refund delivery or order charges in these cases.

Some postal addresses in Northern Ireland, some offshore islands and some remote areas of Great Britain may not be covered by our normal delivery services and so we may have to contact you to advise you of extra postal charges or terminate your order if you do not accept to the additional charges.

If the product(s) you have ordered do not arrive within 10 days of placing the order we accept no liability unless you have contacted us via email within this period to alert us of the problem.

For the all our Delivery options on our website we select the best courier for the job. The standard delivery option refers to an economy service where by we select the cheapest reliable service at that given time. We check prices frequently and have the right to use the best option for us. The majority of smaller items we will use first and second class Royal Mail which is estimated to be delivered in 1-3 working days, but this is not guaranteed and can take longer due to weekends and public holidays. If you have not received your items, you must check with your local sorting office even if you have not received a missed delivery card from your post man.

In the event you have not received your order, allowing for extra time we will replace your item and claim back any losses through the third party courier. In the event that we reproduce an item for you and subsequently the original is returned as undelivered by Royal Mail, we reserve the right to charge you for the replacement.

The priority and Express options on our website are only available Mondays to Fridays, excluding bank holidays and weekends due to the collection and depot times. we do not accept responsibility for not been able to deliver the item to you in the time scale.

Any orders placed after 12 midday will go out the following day.

Order Cancellations/Refunds

Once the order is placed you agree for us to process your order straight away to the specification you provided on our website. In order to provide a fast efficient service some products are immediately sent to print. Please check your order on screen and the confirmation email carefully as we cannot be held accountable for mistakes. Unfortunately due to the personalised, bespoke nature of our products the right to a refund under the Consumer Protection (Distance Selling) Regulations 2000 does not apply to these products. Our items are all tailored made to your specification and therefore cannot be resold or reused in anyway therefore waiving the right to a refund.

Faulty Goods

We aim to package every item delicately. In the event your item(s) arrive damaged please send us a photographic evidence of the damaged goods to info@picturethatgift.co.uk within 24 hours of receiving the goods. Once we verify the goods as faulty we will look to reproduce your order and send it to you free of charge. We may request that you return the item to us. Please take case of the item until we are in receipt of the item. The item is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel back to using a delivery service that insures you for the value of the goods as we cannot be held responsible for items lost in the post. We advise you to obtain proof of postage.

Links

You may only share a link to our website through social media attachments on our website and other network channels to share latest offers with friends and family. A link to our home page may be used in a harmless manner but not in a way to misrepresent our business or the services we provide. You may not post a link to our site if you mean to damage our reputation or flame us in anyway. We reserve the right to revoke any links we do not condone on other websites or social media.

Copyright

You must not extract or otherwise use any of the content on the Site. If you are aware that any of our material on the site has been used elsewhere, please contact us to report the concern. If found doing so we will take immediate legal action.

Rest assured you can feel secure while visiting our website. We do not share or discuss any of the information you provide on our website with any third partys. We maintain your privacy. All credit card or bank detail information is not stored on our website. The payment process will be conducted through paypal. Once you proceed to checkout you will be redirected to paypal to complete payment. If your a paypal user there may be stored cards on your account this information will remain on your paypal account. Paypal does not in anyway share these details with us. The way payment is taking is, they take the payment from you then payment is issued to us from them. If you do not have a paypal account then do not worry, paypal will not keep any card details for guest checkouts.

The information you do enter into our site will be stored on our secure (password- and firewall- protected) servers.

If you have sent us emails or uploaded photos. We will destroy these photos and any relevant information once we discover you’ve received your order. Our website & email account servers are secure and protected behind a firewall and maintained and checked for viruses frequently.
